Kerry County Council (hereinafter called “the Council”) in exercise of the powers conferred on it by Section 76 of the Housing Act 1966 and the Third Schedule thereto, as extended by Section 10 of the Local Government (No. 2) Act 1960 (as substituted by Section 86 of the Housing Act 1966) and amended by the Planning and Development Act 2000 and the Water Services Act 2007 has made an Order entitled as above which is about to be submitted to An Bord Pleanála for confirmation.  If confirmed, the Order will authorise the Council to acquire compulsorily, the land described in the Schedule hereto for the purpose of constructing and operating a wastewater treatment plant, stormwater tank and pumping station.

Owners, lessees and occupiers of the land described in the Schedule hereto will receive individual written notice.

Any objection to the proposed land acquisition should be made in writing to An Bord Pleanála, 64 Marlborough Street, Dublin 1, so as to reach the said Board before 17.00 hours on Wednesday, 6th June 2012.  An Bord Pleanála may, at its absolute discretion, hold an oral hearing in relation to the matter.

A copy of the Order and map referred to in it may be seen at all reasonable hours at the offices of the Water Services Department, Kerry County Council, County Buildings, Rathass, Tralee, Co. Kerry, at the Listowel Area Office, Kerry County Council, Bridge Road, Listowel, County Kerry and at the offices of the Water Services Capital Projects Section, Kerry County Council, Castleisland Area Services Centre, Station Road, Castleisland, Co Kerry.




Land other than land consisting of a house or houses unfit for human habitation and not capable of being rendered fit for human habitation at reasonable expense.
