Commencement Notices

It is a notification to the Building Control Authority that a person intends to carry out works or a material change of use to which Building Regulations apply. A Commencement Notice is required for the following:

 

  • Erection of a building.

  • Material alteration or extension of a building.

  • Material change of use of a building.

 

Work in connection with a material alteration (excluding minor works) of a shop, office or industrial building.

The Commencement Notice must be given to the Building Control Authority not more than 28 days and not less than 14 days before commencement of works or a material change of use.

WARNING: FAILURE TO SUBMIT A COMMENCEMENT NOTICE MAY LEAD TO SUMMARY PROCEEDINGS IN THE DISTRICT COURT WHICH CAN RESULT IN A HEAVY FINE

 

Submitting Fees

A fee based on the number of buildings being built must accompany the Commencement Notice. The fee is €30. Where the proposed works relate to more than one building, the fee is €30 per building. Example: Two adjoining terraced houses are taken as two buildings (fee €60). A block of apartments is taken as one building (fee €30). Details and copies of Commencement Notices can be obtained from the Building Control Authority or can be downloaded from this website.

Payment can be made by cheque, cash, postal order or credit card. Cheques and Postal Orders should be made payable to Kerry County Council, Building Control Department.

The most common errors made on Commencement Notices are as follows:

Insufficient Notice - An application will be rejected as invalid if the minimum of 14 days notice is not given on the application form.  A commencement notice will not be accepted if more than 28 days notice is given.  Notice begins on the date the application is received by the Building Control Department.

Incorrect Fee – Do not forget to enclose the appropriate fee.  If in doubt about the amount due, contact the Building Control Department @ Ph (066) 71 23111 for clarification.

No Final Grant – Work cannot commence until you have received your Final Grant of Permission from the Planning Department or granted Fire Safety Certificate Number from the Building Control Section.  For information regarding an application contact (066) 71 23111

Cheque incorrectly completed – Cheques and Postal Orders should be made payable to Kerry County Council, Building Control Department.

7 DAY Notice Fire Certificate Application – A Commencement notice is not required in the case of a building for which a 7 Day Notice Fire Certificate Application has been submitted.
