Advisory Notes for Applicants: Newly Built Houses
• Stage Payments
It is not Kerry County Council’s Housing Department’s policy to enter into a “stage payment” process. It is Council policy to pay an initial 10% of the purchase price as deposit. In the case of newly built houses, the Housing Department will consider paying an increased deposit, i.e. in excess of 10% of the purchase price of the house. The deposit will be paid when the Contracts have been signed and sealed by the Council. The balance of the purchase money will be paid on completion of the house and at the close of sale.
• Management Company
Many housing developments have now a standard planning condition which requires a Purchaser to sign up to a Management Company, which is set up by the Developer to manage the maintenance of the services and the common and open areas of the development and which is also subject to the payment of Management charges.
If such an issue arises in the purchase of the property herein by the Council, you as the Shared Ownership occupants will be required to sign up as a member of the relevant Management Company with full responsibility to comply with the terms and conditions and requirements of the Management Company and to discharge all the levies and Management charges payable.
You will be required to indemnify Kerry County Council against any claims which are the responsibility of the Management Company. It will be necessary for you to consider the legal implications and you are advised to seek your own independent legal opinion on the implications for you in the event of you having to sign up as a member of the Management Company.
• Engineer’s Report
If the property in question is newly built it will be necessary for you to engage the services of a qualified engineer to carry out periodic inspections and surveys on the property during the course of construction. On completion of the property, the Council will require a declaration from that Engineer setting out details of his inspections and surveys and confirming that the property has been completed to your satisfaction and that it is structurally stable in all respects.
