Draft County of Kerry (Segregation, Storage and Presentation of Household and Commercial Waste) Bye-Laws 2018
Kerry County Council in exercise of the powers conferred on it by Part 19 and Section 199 of the Local Government Act 2001, as supplemented by Section 35 of the Waste Management Act 1996, hereby gives notice that it proposes to make new bye-laws to regulate and control the segregation, storage and presentation of household and commercial waste within its functional area. It is also proposed to revoke the Kerry County Council (Presentation of Household Waste and Commercial Waste for Collection) Bye-Laws 2005.
It is proposed to make provision in the bye-laws for the imposition of a fixed payment of €75 in respect of a contravention of a bye-law as an alternative to a prosecution, as provided for in Section 206 of the Local Government Act 2001.
The Draft Bye-Laws will be available for public inspection from Friday 13th July until Friday 28th September 2018, during normal opening hours, at Kerry County Council Offices, Maine Street, Tralee at Áras an Chontae, Rathass, Tralee, and at all Municipal District Offices, Libraries and on the Council’s website (see below), www.kerrycoco.ie . A copy of the Bye-Laws will be given to any such person applying for it, free of charge.
Kerry County Council will consider any submissions made in relation to the Draft Waste Presentation Bye-Laws. Submissions can be made, in writing, before 5.00pm on Friday 5th October 2018 to Kerry County Council Environmental Services Department, Maine Street, Tralee, or by email to email@example.com . All submissions must include the name and address of the person/organisation making the submission.
